1. Acceptance of Terms

By accessing or using the RxVigor platform at rxvigor.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service. These Terms constitute a legally binding agreement between you and RxVigor.

2. Description of Service

RxVigor is a telehealth platform that connects patients with licensed healthcare providers for the purpose of evaluating eligibility for and prescribing compounded GLP-1 medications for weight management. RxVigor is not a pharmacy and does not dispense medications directly. Prescriptions are fulfilled by independent, licensed compounding pharmacies.

3. Eligibility

To use our Service, you must:

• Be at least 18 years of age
• Be a resident of a US state where we provide services
• Provide accurate and complete health information
• Not have any contraindications to GLP-1 therapy as determined by your provider

4. Medical Disclaimer

RxVigor is not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911 immediately.

The information provided on this website is for general informational purposes only and does not constitute medical advice. All medical decisions are made by licensed, independent healthcare providers. RxVigor does not practice medicine and does not employ physicians.

Approval for GLP-1 therapy is at the sole discretion of the prescribing physician. RxVigor does not guarantee that you will be approved for treatment.

5. Compounded Medications

Compounded medications are prepared by licensed pharmacies and contain the same active pharmaceutical ingredients as FDA-approved brand-name drugs. However, compounded medications themselves are not FDA-approved. By using our Service, you acknowledge and accept this distinction.

6. Subscription and Billing

Your subscription begins on the date you complete enrollment and is billed monthly. Subscriptions renew automatically unless cancelled before the next billing date. You authorize RxVigor to charge your payment method on file for each billing cycle.

Refunds are available if your provider determines you do not qualify for treatment. Once medication has been shipped, refunds are not available. For billing disputes, contact [email protected].

7. Cancellation

You may cancel your subscription at any time by contacting [email protected] or through your patient portal. Cancellations are effective at the end of the current billing period. There are no cancellation fees.

8. Accurate Information

You agree to provide accurate, complete, and current information during the intake process and to update your information as needed. Providing false or misleading health information may result in termination of your account and could pose serious health risks.

9. Telehealth Consent

By using our Service, you consent to receive healthcare services via telehealth technology. You understand that telehealth has limitations compared to in-person care and that your provider may determine that an in-person evaluation is necessary.

10. Limitation of Liability

To the maximum extent permitted by law, RxVigor and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the three months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which RxVigor is incorporated, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

13. Cash-Pay Program Terms

RxVigor operates exclusively as a cash-pay telehealth platform. The following terms apply to all purchases of telehealth consultations and compounded medications arranged through our Service:

• No Insurance Billing or Reimbursement. You agree not to seek payment, reimbursement, or credit from any private insurance plan, employer health plan, or any state or federal healthcare program (including Medicare, Medicaid, Medicare Advantage, or Medicare Part D) for any consultation fees, medications, or ancillary supplies purchased through RxVigor, regardless of whether your plan covers such items.
• Medicare Part D TrOOP. If you are enrolled in Medicare Part D, you agree not to count any amounts paid through RxVigor toward your Medicare Part D true out-of-pocket ("TrOOP") cost threshold.
• No Deductible Credit. You agree not to apply any amounts paid through RxVigor toward any insurance deductible or out-of-pocket spending requirement under any health plan.
• Personal Use Only. All medications and supplies obtained through RxVigor are for your personal use only. You agree not to sell, resell, repackage, reformulate, trade, barter, export, or distribute any medication or supplies obtained through our Service.
• Eligibility. You represent that you are a resident of the United States or Puerto Rico and are at least 18 years of age.

Violation of these cash-pay program terms may result in immediate termination of your account and may expose you to civil or criminal liability under applicable federal and state laws.
